Sarah Walker: Have your special skills been taken into account as part of your family law property matter? Hi, I am Sarah Walker and I’m a lawyer with the family law team at Turnbull Hill Lawyers.
Today I will be talking about special skills in family law property settlements. Special skills in family law property settlements is best illustrated through an example. For instance, we have a husband who has a special skill in property development. During the relationship, he has accumulated an asset pool of some $15 million as a direct result of his property development skills. Then we have the wife who has during the relationship acted in the role of parent and homemaker. The parties have separated and the husband wants to know whether he has a greater entitlement as a result of his direct contribution through his property development skills.
Previously, the courts would have awarded the husband a greater percentage of the asset pool as a direct result of his contribution through his property development skills. More recently, the courts have acknowledged the important role of parent and homemaker.
It is important to know that the court has a wide discretion when it comes to deciding family law property matters. Therefore, it is important that you talk to a lawyer about your potential entitlements.
